O julgamento da ADPF 54 pelo Supremo Tribunal Federal teve como efeito a regulamentação do início da proteção constitucional à vida, silenciada na Constituição Federal de 1988 e na legislação ordinária. Todavia, a tramitação perante o Legislativo de Projeto de Lei prevendo a criminalização da interrupção da gravidez por diagnóstico de anencefalia fetal reacende as tensões acerca dos limites da atuação dos poderes Judiciário e Legislativo na concretização dos direitos fundamentais, as quais serão analisadas no presente trabalho à luz do (...) direito comparado, a fim de compreender como a regulamentação do direito à vida se estabeleceu em outros Estados Democráticos. This work deals with obstacles hindering a metaphysics of laws of nature in terms of dispositions, i.e., of fundamental properties that are causal powers. A recent analysis of the principle of least action has put into question the viability of dispositionalism in the case of classical mechanics, generally seen as the physical theory most easily amenable to a dispositional ontology. Here, a proper consideration of the framework role played by the least action principle within the classical image of the world (...) allows us to build a consistent metaphysics of dispositions as charges of interactions. In doing so we develop a general approach that opens the way towards an ontology of dispositions for fundamental physics also beyond classical mechanics. (shrink)

Resumen: El supuesto de la constitución del yo a partir de la relación intersubjetiva que surge con el reconocimiento del otro hace emerger el problema del fundamento ontológico del yo. Por una parte, el yo no puede existir de manera aislada, pero por otra, subordinar su constitución a la relación con el otro puede debilitar el yo al hacerlo dependiente, para su constitución, en algo distinto de él. Hacer que la constitución del yo dependa de la relación intersubjetiva plantea la (...) cuestión del inicio: ¿Qué son, antes de relacionarse, aquellos que entran en relación? ¿Si el yo se reconoce a sí mismo reconociendo a otro, qué es aquello que reconoce? Estas preguntas apuntan a la búsqueda de un fundamento ontológico o metafísico para la antropología fenomenológica: el uno no puede depender del otro y a su vez este del primero. La antropología filosófica de Paul Ricoeur, con su énfasis en la corporalidad e historicidad del hombre, además de su diálogo con Aristóteles, ofrece respuesta a estas preguntas. Ricoeur estudia al hombre desde dentro, pero no olvida aquello propio del hombre que hace que el ser humano pueda ser reconocido y capaz de reconocer.: The proposition of the constitution of the self as starting from the intersubjective relationship that emerges from the recognition of the other, presents the problem of the ontological foundation of the self. On one hand, the self cannot exist in isolation, but on the other, making its constitution subordinate to the relation with the other can debilitate the self as it is made dependent, for its constitution, on something different from the self. If the constitution of the self is dependent on the intersubjective relation the question of its origin arises: What are those who enter a relation before relating? If the self only recognizes itself recognizing another, what is it that it recognizes? These questions are directed towards the search for an ontological or metaphysical foundation for the study of phenomenological anthropology. The self cannot depend on the other, and this one, in turn, on the self. Paul Ricoeur’s philosophical anthropology, with its emphasis on the corporeal and historical nature of man, and its dialogue with Aristotle, offers answers to these questions. Ricoeur studies man from his inner life but does not forget that which makes it possible for a human being to recognize and to be recognized. (shrink)

Although acoustic frequency is not a spatial property of physical objects, in common language, pitch, i.e., the psychological correlated of frequency, is often labeled spatially (i.e., “high in pitch” or “low in pitch”). Pitch-height is known to modulate (and interact with) the response of participants when they are asked to judge spatial properties of non-auditory stimuli (e.g., visual) in a variety of behavioral tasks. In the current study we investigated whether the modulatory action of pitch-height extended to the haptic estimation (...) of height of a virtual step. We implemented a HW/SW setup which is able to render virtual 3D objects (stair-steps) haptically through a PHANTOM device, and to provide real-time continuous auditory feedback depending on the user interaction with the object. The haptic exploration was associated with a sinusoidal tone whose pitch varied as a function of the interaction point’s height within (i) a narrower and (ii) a wider pitch range, or (iii) a random pitch variation acting as a control audio condition. Explorations were also performed with no sound (haptic only). Participants were instructed to explore the virtual step freely, and to communicate height estimation by opening their thumb and index finger to mimic the step riser height, or verbally by reporting the height in centimeters of the step riser. We analyzed the role of musical expertise by dividing participants into non musicians and musicians. Results showed no effects of musical pitch on high-realistic haptic feedback. Overall there is no difference between the two groups in the proposed multimodal conditions. Additionally, we observed a different haptic response distribution between musicians and non musicians when estimations of the auditory conditions are matched with estimations in the no sound condition. In the past decade, the availability of genetically modified animals has enabled the discovery of interesting roles for phosphatidylinositol 3‐kinase‐γ (PI3Kγ) and ‐δ (PI3Kδ) in different cell types orchestrating innate and adaptive immune responses. Therefore, these PI3K isoforms appear to be attractive drug targets for the treatment of diseases caused by unrestrained immune reactions. Currently, pharmacological targeting of PI3Kγ and/or PI3Kδ represents one of the most promising challenges for companies interested in the development of novel safe treatments for inflammatory diseases. (...) In this review we provide a general outline of PI3Kγ‐ and PI3Kδ‐specific functions in distinct subsets of inflammatory cells. We also discuss the therapeutic impact of novel compounds targeting PI3Kγ, PI3Kδ or both, in mouse models of autoimmune disorders (systemic lupus erythematosus (SLE) and rheumatoid arthritis), respiratory diseases (allergic asthma and chronic obstructive pulmonary disease) and cardiovascular dysfunctions (atherosclerosis and myocardial infarction). The starting point of the paper is the explicit recognition that the prevalent methodology among economists -namely popperian falsacionism- does not reconstruct as rational the central part of the work of the majority of them. The main thrust of the paper is doublefold. First, a new methodology -abstracted from the analysis of the core of Economic Theory- is proposed which enlarges the scope of rationality in Economics. Second, this new methodology -dubbed the Fix Point Methodology- is posited as a general (...) scientific one. As such it opens new vistas on Truth, specially the conjecture that Reality is a changing entity and the consequent call for professional honesty. (shrink)

According to a wrong interpretation of the Bell theorem, it has been repeatedly claimed in recent times that we are forced by experiments to drop any possible form of realism in the foundations of quantum mechanics. In this paper I defend the simple thesis according to which the above claim cannot be consistently supported: the Bell theorem does not concern realism, and realism per se cannot be refuted in itself by any quantum experiment. As a consequence, realism in quantum mechanics (...) is not something that can be simply explained away once and for all on the basis of experiments, but rather something that must be conceptually characterized and discussed in terms of its foundational virtues and vices. To assess it, we cannot rely on experimentation but rather on philosophical discussion: realism is not a phlogiston-like notion, despite the efforts of the contemporary quantum orthodoxy to conceive it in Russellian terms as the relics of a bygone age. In this work we discuss logical structures related to indistinguishable particles. Most of the framework used to develop these structures was presented in [17, 28] and in [20, 14, 15, 16]. We use these structures and constructions to discuss possible ontologies for identical particles. In other words, we use these structures in order to characterize the logical structure of quantum systems for the case of indistinguishable particles, and draw possible philosophical implications. We also review some proposals available in the literature (...) which may be considered within the framework of the quantum logical tradition regarding the problem of indistinguishability. Besides these discussions and constructions, we advance novel technical results, namely, a lattice theoretical structure for identical particles for the finite dimensional case. This kind of approach was not present in the scarcely literature of quantum logic and indistinguishable particles. (shrink)

Although the idea of dignity has always been applied to human beings and although its role is far from being uncontroversial, some recent works in animal ethics have tried to apply the idea of dignity to animals. The aim of this paper is to discuss critically whether these attempts are convincing and sensible. In order to assess these proposals, I put forward two formal conditions that any conception of dignity must meet and outline three main approaches which might justify the (...) application of dignity to animals: the species-based approach, moral individualism and the relational approach. Discussing in particular works by Martha Nussbaum and Michael Meyer I argue that no approach can convincingly justify the extension of dignity to animals because all fail to meet the formal conditions and do not provide an appropriate basis for animal dignity. I conclude by arguing that the recognition of the moral importance of animals and their defense should appeal to other normative concepts which are more appropriate than dignity. (shrink)

According to a widespread view, the Bell theorem establishes the untenability of so-called ‘local realism’. On the basis of this view, recent proposals by Leggett, Zeilinger and others have been developed according to which it can be proved that even some non-local realistic theories have to be ruled out. As a consequence, within this view the Bell theorem allows one to establish that no reasonable form of realism, be it local or non-local, can be made compatible with the (experimentally tested) (...) predictions of quantum mechanics. In the present paper it is argued that the Bell theorem has demonstrably nothing to do with the ‘realism’ as defined by these authors and that, as a consequence, their conclusions about the foundational significance of the Bell theorem are unjustified. Perhaps no philosopher is more of a conundrum than Nietzsche, the solitary rebel, poet, wayfarer, anti-revolutionary Aufklärer and theorist of aristocratic radicalism. His accusers identify in his 'superman' the origins of Nazism, and thus issue an irrevocable condemnation; his defenders pursue a hermeneutics of innocence founded ultimately in allegory. In a work that constitutes the most important contribution to Nietzschean studies in recent decades, Domenico Losurdo instead pursues a less reductive strategy. Taking literally the ruthless implications of Nietzsche's anti-democratic (...) thinking - his celebration of slavery, of war and colonial expansion, and eugenics - he nevertheless refuses to treat these from the perspective of the mid-twentieth century. In doing so, he restores Nietzsche's works to their complex nineteenth-century context, and presents a more compelling account of the importance of Nietzsche as philosopher than can be expected from his many contemporary apologists. Plato's political thought gave rise to a number of concepts and issues - such as the idea of a normative theory, the philosophical foundation of politics, the philosopher-kings, the standard of utopian theory - which have played a significant role on Western political and philosophical thought. -/- This volume aspires to bring out Plato's concept of efficacy in a normative theory. -/- By efficacy, the author means the way in which the theory conceives of its practical realization. If in the (...) Republic this issue is particularly problematic, in the Laws, instead, the claim of realizability becomes the main concern. -/- By defining the concept of efficacy and going through the main works of Plato, this conceptual and textual analysis aims to shed a new light on Plato's political thought, which is neither a utopia, nor a short term political program, but the first normative theory encompassing a theory of efficacy.
